With the process of civil disputes through the Courts becoming far more expensive and time consuming for most people, the Chartered Institute of Arbitrators (CIArb) have launched a new dispute resolution scheme. The scheme known as The Business Arbitration Scheme (BAS) has been designed to greatly speed up and simplify the procedure while still preserving and possibly enhancing the fairness of commercial dispute resolution.
BAS has been developed by the CIArb to provide simple and timely resolution of disputes of low to medium monetary value between £5,000 - £10,000 before a sole arbitrator.
The scheme is operated by the ClArb’s dispute appointment services (DAS) and aims to provide parties with final legal binding decisions on their dispute in less than 90 days from the appointment of the arbitrator by adopting the simplest procedure tailored to match the dispute in question.
There is a fixed fee of £1,250 plus VAT payable by each party. The ClArb, Solent Mediation and other providers are able to deal efficiently, professionally with all types of civil disputes at a fraction of the cost of legal proceedings. The process is easy, effective and private. Dealing with disputes in this manner is greatly encouraged by the courts and many professional organisations. The procedure is likely to continue to grow in popularity in the future.
